- Personal Information:
When you sign up for the LexDex Service, we collect your e-mail address, as well as your name, address and telephone number if you provide them (which is optional). We will use your e-mail address if we need to contact you for inquiry responses or if we need to terminate your Subscriber status. We do not share any personal information with any third parties.
- Cookies:
When you sign up for the LexDex Service, we also collect your browser type and IP address and store that information using "cookies." A cookie is a data file that our Web server sends to your Web browser, which your browser stores and sends back to our server every time you log in to the Web Site. We use a “persistent cookie” that stores your login ID, but not your password, to make it easier for you to log in when you come back to the Web Site. We also use a “session cookie” (also known as a “transient cookie”) that tells us each time you – or someone using the computer from which you signed up – has logged in to the Web Site. When you log out and close your browser, that session cookie will be erased. You can disable the cookies using the settings in your browser.
- Governing Law, Jurisdiction, Time Limit on Claims :
If you have any dispute with us, the dispute will be governed by the laws of the State of New York without regard to its conflict of law provisions. You hereby submit to personal jurisdiction by and venue in the state and federal courts of the State of New York, City of New York. Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the LexDex Service or the TOU must be filed within one (1) year after such claim or cause of action arose or be forever barred.
- Additional Terms:
Our failure to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision. If a court of competent jurisdiction holds any provision of the TOU invalid, the court should try to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOU will remain in full force and effect.
- Termination of Your Subscription:
You may terminate your subscription at any time, for any reason, by sending LexDex a snail-mail or an e-mail notice of termination at accounts@lexdex.com and receiving confirmation from us that we have received the notice.
We may terminate your Subscriber status if your credit card fails to clear or if we have reason to believe that you have violated these TOU, by sending notice to you at the e-mail address you provide in your application for registration, or any other e-mail address that you may later provide to us.
If we have reason to believe that you have violated these TOU, in addition to terminating your We have the right to investigate any allegations that you have violated these TOU and to take whatever action we think is necessary or appropriate to remedy such violations, including, without limitation, terminating your subscription and reporting your conduct to the appropriate legal authorities.
If we receive a notice of termination from you, or if we terminate your subscription, we will disable your account and you will no longer have access to the LexDex Service, but we will not refund any Subscription Fee that you have paid.
